Immigration to Canada under the Start-Up Visa program

The Canadian government has approved more than 40 Canadian business incubators. Each business incubator has its own process for accepting business projects and the criteria used to evaluate them. We select a business incubator for you in Canada and prepare you for admission.

Training is necessary to ensure you understand how to do business in Canada. Each institute offers different training programs, the average duration of which is about 2 weeks.

After successfully completing the training program, you will need to present your business project to the business institute commission. Entrepreneurs who successfully complete the course and prepare a business plan for their project become residents of the business incubator and receive a letter of support, which is an integral part of the Start-Up Visa immigration program.

There are two options for your move. The first involves a quick move, where you receive a Work Permit. The spouse gets a job (Open work permit), and the children go to study (Study permit). In this case, you obtain permanent resident status while in Canada. Second, you are waiting to become a resident before moving to Canada.

It is important for an entrepreneur to complete two main steps. First you need to gain the trust and support of an organization approved by the Government of Canada (Designated Organization). If your project is assessed positively, the organization will provide you with a Letter of Support. It is on the basis of this letter that you will be able to draw up and submit a package of documents to obtain Permanent Residence status.

The duration of the course varies depending on the incubator: some offer a 3-month program with 2-3 classes per week, while others provide intensive training over 2 weeks with daily classes.

As part of the program, only the founder of the company receives training, and his entire family has the right to move without additional payment. Family is considered to be your spouse and minor children, including children from previous marriages of both you and your spouse. You do not need to be legally married to participate in the program, as Canada recognizes civil unions. This startup program allows your family to come to Canada with you right away, unlike immigration programs in some other countries where the family joins at a later date.

The process of obtaining permanent residence in Canada differs from many other countries where a residence permit is first issued. The wait for permanent resident status (Permanent Residence) is quite long, but you can get a work visa (Work Permit) as part of your startup during the period of consideration of permanent residence. It is necessary to justify that the project requires a person’s presence in Canada and work in this company. The processing time for a work visa usually takes 3-4 months.

To immigrate to Canada, you will need to prove that you have sufficient funds in your bank account. The amount you need to have in your bank account depends on the size of your family and is subject to change. For example, the current requirement for a single person is C$13,310 and for a family of three it is C$20,371. Typically, confirmation is an account statement or a certificate of the balance of funds in the account.

Under the terms of the Start-up Visa program in Canada, after arrival you must be a member of a business incubator for 1 year. Membership costs vary by business incubator and start at C$250 per month. Additionally, you will need to register your company in Canada and operate your business while in the country.

To qualify for Canadian citizenship, several conditions must be met. First of all, you must have Permanent Residence status. It is also required to have lived in the country for at least 3 years within the last 5 years (not necessarily continuously). In addition, you will have to pass a citizenship test.
