The package of documents is submitted by the applicant personally to the United States Citizenship and Immigration Services (USCIS) no later than 1 year from the date of entry into the country. But sometimes consideration of the decision may take longer, and information about it will be sent to the applicant by mail.

Refugee status can be obtained by an immigrant who is in the United States and has a well-founded fear of persecution in his home country. Grounds for requesting asylum may include persecution due to political opinion, religious belief, membership of a social group, race or nationality, or sexual minority.

Evidence can be subjective or objective. Subjective is your personal opinion, as well as your experiences, concerns and fears for health, property and life in your homeland in the future. Objective ones are criminal cases, documents, protocols, certificates, publications in the media, evidence, precedents related to any discrimination. Subjective feelings must be supported by objective facts and evidence - the immigrant must indicate in the petition the source of persecution (the state or specific individuals), and also confirm the lack of protection from the authorities in his home country.

Refugees in America will not be available to persons who persecuted others for political reasons or due to discrimination on any basis. Also, asylum will not be provided to those convicted of serious crimes, those who pose a danger to the United States, or are hiding in a given country after committing a crime in their homeland. Refugee status will not be granted to persons permanently residing in countries other than their own before arriving in the United States.

Yes, your spouse and non-family children under 21 can request status. If you have loved ones living outside the United States, you can apply for family reunification after you receive refugee status.

In such a situation, leaving the country is a risky step. While your application is pending, leaving without special permission (Advance Parole) may be perceived as a refusal of your application for asylum. There is a possibility that you will be prohibited from returning to the US. Please note that even with an Advance Parole document, return to America is not guaranteed.

12 months after being granted refugee status, you will be able to apply for a green card. After four years of living in the United States with a green card, you can obtain citizenship by naturalization.
